By accessing and using Alpha FX's platform and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Description of Services

Alpha FX provides algorithmic trading platform services, including but not limited to:

• Automated trading algorithm creation and management
• Market data and analysis tools
• Portfolio management and tracking
• MT5 integration and connectivity
• Risk management tools

3. Account Registration

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept full responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Trading Risks

Important Risk Disclosure:

Trading in financial markets involves substantial risk of loss. You acknowledge and agree that:

• Past performance does not guarantee future results
• Algorithmic trading carries inherent risks and may result in losses
• You are solely responsible for your trading decisions
• You should only trade with capital you can afford to lose
• Alpha FX does not provide investment advice or recommendations

5. User Responsibilities

You agree to:

• Use the platform only for lawful purposes
• Not attempt to gain unauthorized access to our systems
• Not interfere with or disrupt the platform's operation
• Not use automated systems to access the platform without permission
• Comply with all applicable laws and regulations
• Maintain adequate funds in your trading account

6. Fees and Payments

You agree to pay all applicable fees for the services you use. Fees are:

• Charged according to your selected subscription plan
• Billed in advance on a monthly or annual basis
• Non-refundable except as required by law
• Subject to change with 30 days' notice

6A. Refund Policy

Alpha FX is committed to ensuring client satisfaction. Refund requests are subject to the following terms and conditions:

• 7-Day Refund Window: Eligible refund requests must be submitted within seven (7) calendar days from the date of the initial payment or subscription activation. Requests submitted after this period will not be considered.
• Refunds are only applicable to subscription fees and platform access charges. Losses incurred through trading activity, algorithmic execution, or market exposure are strictly non-refundable under any circumstances.
• To initiate a refund, clients must submit a formal written request to our support team at legal@alphafx.com, including the account details, transaction reference, and reason for the request.
• Approved refunds will be processed within 5–10 business days and returned via the original payment method. Alpha FX reserves the right to deduct any applicable processing or administrative fees.
• Refund eligibility may be revoked if the account has been found to have violated these Terms of Service, engaged in fraudulent activity, or abused the refund process.

7. Intellectual Property

All content, features, and functionality of the Alpha FX platform are owned by Alpha FX and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Alpha FX shall not be liable for:

• Any trading losses or financial damages
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or technical failures
• Third-party actions or market conditions

9. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Account Termination & Inactivity Policy

We reserve the right to suspend or terminate your account under the following circumstances:

• You violate any provision of these Terms of Service
• You engage in fraudulent, deceptive, or illegal activities
• You fail to maintain adequate account funding or compliance requirements
• We are required to do so by applicable law or regulatory authority

You may voluntarily terminate your account at any time by submitting a written request to our support team. Upon voluntary termination, all active algorithms will be deactivated and open positions must be closed prior to account closure.

11. Dispute Resolution

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or through the platform. Your continued use of the services after such changes constitutes acceptance of the modified terms.
